Midtown CVS employee accused of fatally stabbing would-be shoplifter

Scotty Enoe, 46, was charged with murder and criminal weapons possession, police said.
A CVS employee appeared before a judge Friday afternoon after allegedly stabbing and killing a homeless man who was trying to shoplift from the store, according to police.
Scotty Enoe, 46, was arraigned on counts of murder in the second degree, manslaughter in the first degree and criminal weapons possession for the death of Charles Brito, 50.
Brito was reportedly trying to steal from the Midtown location around midnight on Thursday, police said.
Officers responding to a call about a robbery in progress found Brito with a stab wound to the torso at the CVS on the corner of Broadway and West 49th Street.
"I did not stab him over CVS products," Enoe said at the scene, according to court documents. "I stabbed him over punching me. Look what he did to my face."
ABC reported that Enoe is in police custody at Mount Sinai West, where he is being treated for injuries sustained during the scuffle.
"I don't think he's a bad guy," said Andrew Freedman, Eone's lawyer. "He's 46-years-old with no prior criminal history."
"This wasn't a situation that he was looking for or was brought on, but was brought on to him by a serial criminal," said Freedman.
CVS spokesperson Kara Page said the company is “cooperating with police in their investigation of this incident.”
